Notice-and-Action Policy and Content Moderation Statement

This Notice-and-Action Policy (DSA Art. 16) explains how TriDev Tech EOOD handles reports of illegal content and Community Guidelines violations on Whisper, in accordance with Regulation (EU) 2022/2065 (the Digital Services Act, “DSA”).

Automated Content Moderation

Whisper uses automated tools to assist in content moderation:

AI-Assisted Moderation: We use OpenAI’s moderation API (omni-moderation-latest) to automatically screen content submitted to the platform for violations including sexual content, violence, harassment, self-harm, and illegal activity. This system processes text and images in real-time upon submission.

Human Review: Automated flags are reviewed by our moderation team for significant enforcement actions such as account suspension or termination. Automated removal may occur without prior human review for high-confidence violations (e.g., CSAM), as required by law.

Content States: Content on Whisper may be in one of the following states:

  • Active: Visible to users as intended
  • Under Review: Flagged for human review; may be temporarily restricted
  • Removed: Removed for violating our policies; uploader notified where required
  • Reported to Authorities: Reported to relevant law enforcement or regulatory bodies (e.g., IWF for CSAM)

1. What Can Be Reported

You may report:

• Content you believe is illegal under EU or Member State law

• Content that violates our Terms of Service or Community Guidelines

• Accounts engaged in prohibited activities

2. How to Submit a Report

2.1 In-App Reporting

Use the report button available on all content and profiles: tap the Three Dots on any post and select “Report”.

2.2 Email

Reports may also be submitted to: support@whisper-app.net. The report should include:

• Your contact information (for follow-up)

• The specific content or account being reported

• The reason for your report

• An explanation of why you consider the content illegal or violating

• If applicable, reference to the legal provision you believe is violated

• Declaration of good faith accuracy of information provided

3. Information Requirements for Reports of Illegal Content

For reports concerning allegedly illegal content under Article 16 DSA, please provide:

• Sufficient detail to locate and identify the content

• Your name and email address (unless the illegality relates to certain crimes)

• A clear statement explaining why you consider the content illegal

• Where applicable, the specific EU or Member State law you believe is violated

• A declaration confirming the good faith accuracy of your report

• Reports lacking this information may be processed as Community Guidelines reports rather than formal Article 16 notices.

4. How We Process Reports

4.1 Acknowledgment

We will acknowledge receipt of your report without undue delay.

4.2 Review

Our content moderation team will review the reported content, considering:

• The content of the report and any evidence provided

• Applicable laws and our Terms of Service

• Context, including newsworthiness and public interest

• The rights of all parties involved, including freedom of expression

4.3 Decision

We will make a decision in a timely, diligent, non-arbitrary, and objective manner. For clearly illegal content, we will act expeditiously to remove or disable access.

4.4 Notification

We will notify both the reporter and the content provider of our decision, including:

• The decision taken (removal, restriction, or no action)

• The reasons for the decision

• Information about the legal or contractual basis

• Information about appeal rights and procedures

• If content was removed, information about the report that led to the decision

• Notifications may be delayed or withheld where required by law (e.g., law enforcement requests) or to prevent harm.

5. Appeals Process

5.1 Who Can Appeal

• Content providers whose content was removed or restricted

• Account holders whose accounts were suspended or terminated

• Reporters whose reports were rejected

5.2 How to Appeal

Appeals may be submitted by email to office@whisper-app.net. Your appeal should include:

• A reference to the decision (e.g., the content or account affected)

• An explanation of why you believe the decision was incorrect

• Any supporting evidence

Appeals must be submitted within 3 months of the decision.

5.3 Appeal Review

Appeals are reviewed by personnel not involved in the initial decision. We will:

• Consider the appeal promptly and diligently

• Reverse our decision if appropriate

• Notify the appellant of our decision with reasons

6. Trusted Flaggers

Reports from entities designated as “trusted flaggers” under Article 22 DSA will be processed with priority.

7. Misuse of Reporting System

Users who frequently submit manifestly unfounded reports or appeals may have their reports deprioritized or, after warning, may be temporarily suspended from using the reporting system.

8. Orders from Authorities

We comply with lawful orders from Member State authorities to act against illegal content or provide information, in accordance with Articles 9 and 10 DSA.

Statement of Reasons

When we restrict, remove, or disable access to content, or suspend or terminate an account, we will provide the affected user with a clear and specific statement of reasons, including:

  • The facts and circumstances leading to the decision
  • The specific provision(s) of our Terms of Service or Community Guidelines that were violated
  • Information about the user’s right to appeal the decision

Statements of reasons are delivered via in-app notification and/or email. Where providing reasons would compromise the investigation of illegal activity or the safety of another person, we may delay or limit the information provided, as permitted by law.

Out-of-Court Dispute Settlement

If you are not satisfied with the outcome of our internal appeals process, you may refer the matter to a certified out-of-court dispute settlement body. We commit to engage in good faith with any certified dispute settlement body under DSA Art. 21.

You may also contact the relevant Digital Services Coordinator in your EU Member State, or the European Commission’s enforcement bodies, as applicable.
