• Respect for Intellectual Property

TriDev Tech EOOD respects intellectual property rights and expects users of Whisper to do the same. We comply with applicable copyright laws, including Directive 2001/29/EC (InfoSoc Directive) and Directive 2019/790 (DSM Directive).

2. Prohibited Content

Users may not post content that infringes the intellectual property rights of others, including:

• Copyrighted works (music, videos, images, text) without authorization

• Trademarks used in a manner likely to cause confusion

• Trade secrets or confidential information

3. Reporting Infringement

3.1 Copyright Infringement Notices

If you believe your copyright has been infringed, please submit a notice containing:

• Identification of the copyrighted work(s) claimed to be infringed

• Identification of the material claimed to be infringing, with sufficient detail to locate it

• Your contact information (name, address, telephone, email)

• A statement that you have a good faith belief the use is not authorized

• A statement, declaring in good faith that the information provided is accurate, that you are authorized to act on behalf of the copyright owner

• Your physical or electronic signature

3.2 Trademark Infringement

For trademark infringement reports, contact support@whisper-app.net with similar information regarding the trademark at issue.

4. Counter-Notice Procedure

If you believe your content was removed in error, you may submit a counter-notice containing:

• Identification of the material removed and its location before removal

• A statement, declaring in good faith that the information provided is accurate, that you believe the material was removed by mistake or misidentification

• Your name, address, telephone number, and email address

• A statement consenting to jurisdiction in Republic of Bulgaria

• Your physical or electronic signature

We will forward counter-notices to the complaining party. If no legal action is initiated within 30 business days, we may restore the content.

5. Repeat Infringer Policy

We maintain a policy for termination of accounts of users who are repeat infringers of intellectual property rights.

Definition of Repeat Infringer: A user who has received three (3) valid infringement notices within one month.

Process:

• First valid notice: Warning and content removal

• Second valid notice: Additional warning and temporary account restriction

• Third valid notice: Account suspension or termination

• Counter-notices that result in content restoration do not count toward repeat infringer status.

We reserve discretion in applying this policy, considering factors such as the nature of infringement, good faith, and overall account history.

6. Appeals

Users may appeal infringement decisions by contacting office@whisper-app.net with:

• Reference to the notice or decision

• Explanation of why the decision was incorrect

• Any supporting evidence

• Appeals will be reviewed and responded to within one month.

7. Good Faith Reporting

Submitting false or misleading infringement notices may result in liability. We reserve the right to seek damages from parties who submit bad-faith notices.
